Welcome to Maildeno ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your use of our email template rendering API, dashboard, documentation, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part, you may not access the Service.

2. Definitions

• API – Our application programming interface for rendering email templates.
• Service – The API, dashboard, documentation, and any associated tools.
• Subscription – Your paid plan for accessing the Service.
• Templates – Email templates you create and render through our Service.
• Usage – Number of API calls, template renders, or bandwidth consumed.

3. API Usage Guidelines

You agree to use the API in accordance with our documentation and rate limits. You may not:

• Use the API for sending spam or unsolicited emails
• Attempt to bypass rate limits or security measures
• Reverse engineer or decompile the API
• Use the Service for illegal activities
• Share your API keys publicly or with unauthorized parties

4. Account Responsibilities

You are responsible for maintaining the security of your account and API keys. You agree to accept responsibility for all activities that occur under your account. Notify us immediately of any unauthorized access.

5. Pricing and Payments

Subscription fees are billed in advance on a monthly or annual basis. We reserve the right to change pricing with 30 days' notice. All fees are non-refundable except as required by law.

6. Service Level Agreement

We aim for 99.9% uptime for our API. Scheduled maintenance will be announced in advance. We provide support during business hours for all paid plans, with priority support for enterprise customers.

7. Data Ownership

You retain all ownership of your templates and content. We do not claim any rights over your email templates. We collect usage data to improve our Service but do not access your email content.

8. Intellectual Property

The Service, including our API, dashboard, documentation, and logos, is owned by Maildeno and protected by copyright and other intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.

9. Termination

We may terminate or suspend your account immediately for violations of these Terms. You may cancel your subscription at any time through your dashboard. Upon termination, your API keys will be revoked, and you will have 30 days to export your templates.

10. Limitation of Liability

To the maximum extent permitted by law, Maildeno shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the preceding 12 months.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure. Your use of the Service is at your sole risk.

12. Governing Law

These Terms shall be governed by the laws of Delaware, United States, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the dashboard. Your continued use of the Service constitutes acceptance of the modified Terms.
